New Court Case Filing Fees went into effect on July 1st 2015

Circuit Court Filing Fees - Services By Mail:

  • Civil Cases (Includes Adoptions) $156.00*
  • Mortgage Foreclosures $206.00 * & ****
  • Juvenile Cases (Includes Paternity) $175.00 **
  • Probate Cases (Includes Guardianships)$176.00   

Circuit Court Filing Fees - Services By Sheriff's Department:

  • Juvenile Cases (Includes Paternity) $200.00 **

Superior Court Filing Fees - Services By Mail:

  • Small Claims Cases $96.00***
  • Civil Cases $156.00*
  • Criminal Cases $183.00**

Superior Court Filing Fees - Services By Sheriff's Department:

  • Small Claims Cases $121.00***
  • Civil Cases $181.00*
  • Criminal Cases $208.00**

 Notations:

  • *Filing Fee includes Service Fee for first-named defendant.  Add $10.00 for each defendant added thereafter.  Also, add a $10.00 fee per garnishee defendant in excess of three (3) whether named or added.
  • **Additional fees may apply as determined by the judge, the charge, and the outcome of the case.  
  • ***Add $10.00 additional Service Fee for any party adding a defendant to the action. ($81.00 includes $10.00 Service Fee for first defendant named, payable by party filing the action.) Also, add a $10.00 fee per garnishee defendant in excess of three (3) whether named or added.
  • ****Add $50 Mortgage Foreclosure Counseling and Education Fee was resurrected 5/6/2015 and is included in the amounts shown above. (After 7/1/2015 this extra $50 fee goes away.)

Anyone requesting service of process by certified mail must supply the completed certified mail materials, including the envelope with postage prepaid and the Clerk as the return address.

Language in HEA!371 and SEA2 have conflicting information about certified mailings, regarding who pays for what. We hope to get clarification soon, but until then we will require as per the above.

These fees become effective on July 1, 2015.
